  • Mobile Device Data. We automatically collect device information (such as your mobile device ID, model, and manufacturer), operating system, version information and system configuration information, device and application identification numbers, browser type and version, hardware model Internet service provider and/or mobile carrier, and Internet Protocol (IP) address (or proxy server). If you are using our application(s), we may also collect information about the phone network associated with your mobile device, your mobile device's operating system or platform, the type of mobile device you use, your mobile device's unique device ID, and information about the features of our application(s) you accessed.
  • Push Notifications. We may request to send you push notifications regarding your account or certain features of the application(s). If you wish to opt out from receiving these types of communications, you may turn them off in your device's settings.

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.
We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.
Like many businesses, we also collect information through cookies and similar technologies.
The information we collect includes:
  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings).
  • Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
  • Vehicle Telematics, Video, and Location Data (via ELD and Lytx Devices). When you or your organization install and operate our electronic logging devices (ELD) or the LytxOne AI Video Gateway and dashcam Devices in a vehicle, those Devices automatically record and transmit, depending on configuration:
    • Telematics data — vehicle speed, RPM, engine status, fuel level, odometer, diagnostic trouble codes, ignition state, and other CAN/OBD-II signals.
    • Location and route data — GPS coordinates, heading, time-stamped travel history, stops, and route information.
    • Driving behavior and event data — acceleration, deceleration, harsh braking, cornering, lane weaving, tailgating, speeding, collisions, and other driving events, including data from the Device's gyroscope, accelerometer, and compass used to detect and classify such events.
    • Video and audio — road-facing and/or driver-facing video and in-cabin audio captured by the Device cameras and microphones. Such footage may capture the vehicle, the vehicle's interior (including the face, body, expressions, speech, and behavior of the Driver and Passengers), and the vehicle's surroundings (including pedestrians, cyclists, and other Other People in the public domain).
    • Driver identification and HOS data — driver name, employee/contractor ID, carrier and vehicle (VIN, unit number, plate), duty status, and hours-of-service (HOS) logs required by the FMCSA ELD mandate.
    • Devices data — information about the AI Video Gateway, dashcam hardware, firmware version, and network status used to ensure proper operation.
    • Usage, logs, and analytics — device information and identification numbers, operating system information, IP address, browser and session information, configuration information, file metadata, and usage information (such as screen views, clicks, and usage time).
    Not all video, audio, and sensor data captured by the Devices is transmitted to FIRST ELD or the LytxOne Platform. Customers (fleets) configure on the Application the means and triggers for data collection and retention for each Device, and some data may remain stored locally on the Device's memory under the Customer's sole control. Drivers and passengers should direct questions about in-cab video, audio, or telematics data first to their employer (the Customer and Data Controller).

Information collected from other sources

In Short: We may collect limited data from public databases, marketing partners, and other outside sources.
In order to enhance our ability to provide relevant marketing, offers, and services to you and update our records, we may obtain information about you from other sources, such as public databases, joint marketing partners, affiliate programs, data providers, and from other third parties. This information includes mailing addresses, job titles, email addresses, phone numbers, intent data (or user behavior data), Internet Protocol (IP) addresses, social media profiles, social media URLs, and custom profiles, for purposes of targeted advertising and event promotion.
Information collected when you use our Facebook application(s). We by default access your Facebook basic account information, including your name, email, gender, birthday, current city, and profile picture URL, as well as other information that you choose to make public. We may also request access to other permissions related to your account, such as friends, check-ins, and likes, and you may choose to grant or deny us access to each individual permission. 2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.
We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.
  • Business Partners. We may share your information with our business partners to offer you certain products, services, or promotions.
  • Lytx, Inc. (LytxOne Platform and Devices). We rely on Lytx, Inc. ("Lytx") as a hardware manufacturer, software-as-a-service provider, and data processor for our AI dashcam, video telematics, and fleet management offering. Video, audio, telematics, GPS, driving-behavior, and Device data captured by Lytx Devices installed in your vehicles is transmitted to and processed on the LytxOne Platform on behalf of your organization. Lytx processes this data as a Processor under its own Lytx Privacy Policy and LytxOne License Agreement. Lytx hosts customer data primarily on Amazon Web Services (AWS) in the United States and maintains R&D and customer support functions in additional countries, including Israel and India. Lytx may engage its own sub-processors (including hosting and backup providers such as AWS, analytics providers, telecommunication services, media transmission services, security technology, IT and system administration, payment processing, technical support, research and analytics, telecommunication vendors, and customer support) on a need basis for the performance of the Platform and Devices.
  • Other Subprocessors. We may disclose information to additional third-party service providers acting on our behalf, such as hosting, analytics, customer support, payment, telecommunications, and security vendors, under written contracts requiring appropriate confidentiality and security obligations.
  • Law Enforcement, Courts, and Government Authorities. We may disclose your information to law enforcement agencies, courts of law, and other governmental organizations when ordered to do so by competent bodies and according to applicable law, or where we or our Customers reasonably believe disclosure is necessary to protect rights, property, or safety, or to respond to accidents, insurance claims, or legal proceedings.

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ( "DNT" ) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized . As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

16. LYTX PLATFORM, DEVICES, AND DATA PROCESSING

In Short: Our AI dashcam, video telematics, and fleet-management hardware and software are powered by the LytxOne Platform operated by Lytx, Inc. Your fleet (the Customer) is the Data Controller of personal data captured by the Devices; FIRST ELD and Lytx act as Data Processors on the Customer's behalf.

16.1. Who Lytx Is and What They Do

FIRST ELD resells, deploys, and supports hardware devices and a cloud-based software-as-a-service platform manufactured and operated by Lytx, Inc. ("Lytx"), headquartered at 9785 Towne Centre Drive, San Diego, California 92121, United States. The LytxOne Platform is a fleet-management technology that enables organizations to collect and process video, audio, telematics, and location data from AI video and telematics Devices installed in the organization's vehicles, and to keep sight of their fleet, operations, and the driving safety of their staff, and to protect their interests in case of accidents or insurance claims.

16.2. Controller / Processor Relationship

Under the LytxOne License Agreement and applicable data-protection laws (including the California Consumer Privacy Act as amended by the CPRA and analogous U.S. state and international privacy laws):
  • The Customer (the fleet, carrier, or other organization that purchases and deploys the Devices) is the "business" / "data controller" with respect to personal data captured through its Devices and processed on its LytxOne Account. The Customer decides what data to collect, how long to retain it, who within its organization may access it, and for what purposes.
  • FIRST ELD and Lytx are "service providers" / "data processors" that process personal data on the Customer's behalf, only according to the Customer's instructions as configured in the LytxOne Application and as permitted by the LytxOne License Agreement and this Privacy Policy.
  • If you are a Driver, Passenger, or other individual whose data has been collected via a Device installed in a Customer vehicle, please direct any request to access, correct, delete, restrict, object to, or port your personal data first to your employer or fleet operator (the Customer and Controller). We and Lytx will support the Customer in responding to such requests to the extent required by applicable law.

16.3. Categories of Personal Data Processed via Lytx Devices

The categories of personal data that may be processed on the LytxOne Platform on behalf of our Customers include:
  • Identification and contact details of Users, Drivers, and recipients of shared data, such as name, employee/contractor ID, ID number, title, car plate / VIN number, gender, profile photo, username and password, phone numbers, and email addresses;
  • Video and audio recordings of the vehicle, the vehicle's surroundings (which may include pedestrians and cyclists in the public domain), and the vehicle's interior (including face and body video, expressions, speech, and behavior of the Driver and Passengers);
  • Detailed location, travel, and route information, including GPS signals combined with a time-stamp and other information from the Device;
  • Telematics data on the vehicle, including performance, speed, engine status, fuel levels, and driver behavior;
  • Devices data, including information on the AI Video Gateway, the dashcam Devices, and network status;
  • Driving data — such as speed, acceleration, deceleration, braking, turns, lane weaving, tailgating, stops, and collisions — and sensory and motion data from the Devices, including information from gyroscope, accelerometer, and compass, used to calculate and detect driving events and behaviors (Lytx may use a third party to collect such data);
  • Any personal data contained in videos, media, or other files uploaded by Devices, Customers, or Users;
  • Usage, logs, analytics, and other technical data, including device identifiers, operating system, IP address, browser and session information, configuration information, metadata of files, and usage information.
Not all video, audio, and sensor data captured by the Devices is transmitted to the LytxOne Platform. Customers configure on the Application the means and triggers for data collection for each Device. Some data may remain stored locally on the Device's memory under the Customer's sole and complete control; we and Lytx take no responsibility over video, audio, or other data on the Devices that is not processed online on the LytxOne Platform.

16.4. Purposes of Processing

The purposes for which personal data is processed through the LytxOne Platform are determined by our Customers and may include, without limitation: tracking vehicles and fleet management; encouraging and monitoring driving safety; protecting Customer assets such as their vehicles; protecting the Customer, its staff, and third parties in case of accidents, legal proceedings, and insurance claims; determining or corroborating the circumstances of a lawsuit, claim, loss, or theft; preventing and detecting fraud; supervising professional drivers; route planning; traffic measurement and documentation; complying with the FMCSA ELD mandate and other applicable law; and assisting law enforcement agencies where required under any applicable law.
FIRST ELD and Lytx may also process data collected on the LytxOne Platform to ensure our products and services are working as intended; to analyze, measure, and understand how our services are used; to improve our products and services; to develop new features, products, and services; to protect our company, staff, Customers, Users, Drivers, Passengers, and the general public; and to comply with applicable law.
AI, analytics, and derivative data. The LytxOne Platform may use artificial intelligence (AI) and analytics features to process telematics, video, and audio data for functionality, operations, performance management, fleet management, and safety. Lytx may create derivative, aggregated, anonymized, statistical, or de-identified data that does not identify any individual Customer or person, and may use such data for purposes including improvement and further development of the Platform, Application, and Devices, research purposes, and training, developing, and improving Lytx's AI models. Such derivative data is not personal data under this Privacy Policy.

16.5. Disclosure to Third Parties via the Lytx Platform

For the delivery of services, Lytx discloses User, Devices, and Platform data on the LytxOne Platform (including identifiable information of Drivers, Passengers, and Other People) to the Customer who is the Data Controller with respect to such data. This means that your employer (if you are a Driver, Passenger, or User) has access to and control over the information collected about you through the Devices.
Lytx also utilizes third-party processors in the provision of services, including Resellers (such as FIRST ELD) who sell the Platform to Customers and may also install and operate it with respect to such Customers, cloud hosting providers, IT and system administration, payment processing, technical support, research and analytics, telecommunication vendors, and customer support. Lytx uses additional processors around the world for various processing activities needed for the performance of the Platform, its Application, and its products and services, and discloses information with such processors on a need basis. These processors include hosting and backup providers (such as Amazon Web Services), analytics providers, IT and system administration, payment processing, media transmission services, security technology, telecommunication services, and others.
Lytx may also disclose personal data to law enforcement agencies, courts of law, and other governmental organizations if ordered to do so by competent bodies and according to applicable law. In the event of a merger, asset sale, financing, liquidation, bankruptcy, or acquisition of all or part of our or Lytx's business, personal data may be disclosed to the acquiring company and its advisors.

16.6. International Transfers

Most LytxOne Platform data is stored in the cloud on Amazon Web Services in the United States. Lytx maintains R&D and customer support functions located in Israel and India, and Lytx's business is international — it serves Customers whose vehicles may cross national borders and utilizes additional processors and service providers in various countries. Therefore, your personal information may be transferred to, stored in, or otherwise processed in countries where data protection and privacy regulation may differ from, or be less protective than, the laws of the country in which you live. Lytx implements safeguards in the selection of its processing vendors to require that personal data is subject to appropriate technical and organizational measures.

16.7. Retention

Personal data collected via the LytxOne Platform is retained for different periods depending on the type of information, the term of the applicable contract with the Customer, and legal retention requirements. Generally, data is retained for as long as reasonably needed to fulfill the purposes outlined in this Privacy Policy and the LytxOne License Agreement, unless a longer retention period is required or permitted by law. Where permissible, Lytx may de-identify or anonymize data in lieu of deletion. Customers may also retain copies of personal data collected through the LytxOne Platform on their own systems after we and Lytx have ceased processing it; such customer-side retention is governed by the Customer's own privacy policy and applicable law, not by this Privacy Policy.

16.8. Your Rights With Respect to Lytx-Processed Data

If your personal data has been submitted to us or Lytx in connection with the provision of services to a Customer, and you wish to exercise any rights you may have under applicable data-protection laws — such as the rights to know, access, rectify, delete or erase, restrict, port, object, avoid the sale of your personal data, or not be subject to solely automated decision-making — please first contact the Customer directly. Neither FIRST ELD nor Lytx makes any decisions based solely on automated decision-making that have legal or similarly significant effects on Drivers, Passengers, or Other People, and our Customers commit in the LytxOne License Agreement to avoid such practice as well.
If you do not know who your Customer / Data Controller is, you may contact FIRST ELD at support@firsteld.com or Lytx at privacy@lytx.com, and we will attempt to determine who the Data Controller is and forward your request.

16.9. Children

The LytxOne Platform is a technology platform for fleet management and is not intended for children. We and Lytx do not knowingly collect or process information about children, although Passengers and Other People who are children might be captured on Customers' video or audio data coincidentally. Neither FIRST ELD nor the LytxOne Platform makes any attempt whatsoever to personally identify children, Passengers, or Other People who appear on Customers' data processed on the Platform.

16.10. References

For more information about how Lytx processes personal data and operates the LytxOne Platform, please refer to the Lytx Privacy Policy and the LytxOne License Agreement provided by Lytx. In case of any conflict between this Privacy Policy and the Lytx Privacy Policy with respect to data processed by Lytx on FIRST ELD's or the Customer's behalf, the Lytx Privacy Policy shall govern the processing activities actually performed by Lytx. FIRST ELD remains responsible for its own processing activities as described in this Privacy Policy.
