Proactive MVR Monitoring: A Vital Strategy for Carriers to Mitigate Risks

Trucking can be a risky business. A carrier’s profitability depends largely on the state of the wider economic market, which can be impacted by everything from natural disasters to legislation changes. However, there are steps trucking companies can take to safeguard their operations despite outside unpredictability. One effective strategy is implementing ongoing monitoring of driver motor vehicle records (MVRs).

The Importance of Regular MVR Checks

Carriers are federally mandated to review MVRs only once a year, but doing the bare minimum creates an environment where issues can easily fall through the cracks, leading to costly fines and potentially devastating litigation. By inspecting MVRs regularly, carriers can flag issues early and sidestep future pitfalls.

According to Mark Schedler, J. J. Keller's Sr. Transport Management Editor, “Every day that a disqualified driver operates a CMV is like waiting for a bomb to explode. If the driver is in a crash, the carrier will pay regardless of whether they were at fault. The driver shouldn’t have been there.”

Increased Risks of Unaddressed MVR Violations

The American Transportation Research Institute’s (ATRI) 2022 update of the Crash Predictor study highlights the heightened risk of DOT accidents if MVR violations are left unchecked. Some of the riskiest violations include:

  • Failure to Yield Right-of-Way: 141% risk increase
  • Failure to Use/Improper Signal: 116% risk increase
  • History of Crashes: 113% risk increase
  • Reckless Driving: 104% risk increase
  • Failure to Obey Traffic Sign: 85% risk increase

When drivers with existing, unaddressed violations make these critical errors and get involved in accidents, carriers may face negligent supervision claims. “Reacting to driver violations when they show up on the annual MVR and delaying the correction of unsafe behaviors almost guarantees an excessive verdict due to negligent supervision if those drivers are in a crash,” Schedler elaborated.

Benefits of More Frequent MVR Monitoring

More frequent MVR checks allow carriers to identify and address driver violations or changes in license status at an earlier stage. This timely intervention can prevent issues from escalating. In addition, many insurers offer discounts to carriers that conduct regular MVR monitoring, which can lead to an improved risk profile and lower premiums.

Using Advanced Systems for Proactive Monitoring

Organizations like J. J. Keller offer tools such as the Encompass® Fleet Safety & Compliance System to simplify the process of continuous MVR monitoring. With this system, carriers gain numerous advantages:

  • Timely Notification: Be alerted to changes such as expired CDL medical certifications or administrative suspensions.
  • Improved Driver Retention: Timely coaching and remedial actions help keep drivers before issues require termination.
  • Promotion of Safer Driving Behaviors: By reducing risks promptly, the likelihood of accidents decreases.
  • Protection of Unsafe Driving BASIC Scores: Keep unsafe drivers off the road quickly.
  • Automation: Manage driver records efficiently to save time and resources.

The Future of Fleet Safety

As technology advances, regular driver monitoring is becoming more achievable and essential. Forward-thinking carriers who adopt these tools and practices now will be prepared to build safer, more efficient fleets in the future. Safety is about not just reacting to incidents, but proactively preventing them. Ongoing MVR monitoring is a critical step towards achieving this proactive approach.

By moving beyond the minimum yearly MVR check, carriers can cultivate a continuous improvement culture, reduce risk exposure, and ultimately save lives on the road. The investment in more frequent monitoring leads to enhanced safety, compliance, and operational efficiency.

FMCSA Active ELD Revoke List and the Importance of Compliance

The Federal Motor Carrier Safety Administration (FMCSA) plays a crucial role in ensuring the safety and reliability of commercial motor vehicles on American roads. As part of their oversight, they mandate the use of Electronic Logging Devices (ELDs) to monitor drivers’ hours of service (HOS) and ensure compliance with federal regulations. However, not all ELDs meet the necessary compliance standards. When a device no longer complies with FMCSA regulations or fails to meet performance standards, it is placed on the **FMCSA ELD Revoked List**. Below, we explore some of the key reasons why an ELD might be revoked and provide a table of current revoked devices.
