The Southern District of Texas U.S. Bankruptcy Court ratified a binding settlement term sheet, marking a pivotal step forward. Endorsed by all key creditors, including Freight, Bankruptcy Court Judge Christopher Lopez approved the agreement.
However, reaching this milestone is not the final step. The plan confirmation awaits Judge Lopez's approval, anticipated in April.
Role of a Buyer is Not Clear
While Chapter 11 identifies a buyer in Noor Leasing, what it will acquire remains uncertain, especially in light of Kal Freight’s decision to sell its equipment to meet creditors’ demands. With over 1,500 assets involved, including tractors and trailers, Noor Leasing's purchase details hinge on the liquidation process outcomes.
Prior to plan confirmation, creditors are set to infuse Kal Freight with necessary funding, ensuring assets' orderly surrender to meet debt obligations. In the interim, Kal Freight will receive $1.25 million from Triumph Capital in weekly installments, sustaining operational needs.
'Catastrophic' Fears Raised if Chapter 7 Pursued
A shift towards Chapter 7 bankruptcy, favored by some creditors, poses significant risks of a hastened liquidation. Leading voices, including Triumph and Daimler Truck Financial Services, warned against this hurried option, highlighting scenarios of abandoned trailers and stranded drivers.
Completion of asset transfers is projected for April 18. Unsecured creditors are set for repayment via unencumbered assets placed in a liquidating trust, arranged for their claims settlement.
Background Allegations
Allegations of “malfeasance” accompanied Kal Freight’s bankruptcy filing in December but did not factor into the bankruptcy settlement. Resolving such accusations lies outside the bankruptcy court's purview.
